These Terms of Service ("Terms") govern your use of the Examen mobile application (the "App") developed by Founder's Point("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use as a daily reflection and journaling tool, subject to these Terms and any applicable app store terms.
Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse-engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices, labels, or marks
- Use the App for any unlawful or unauthorized purpose
- Attempt to access, tamper with, or extract other users' data from Apple CloudKit or any related services
Your Content
The App allows you to create journal entries and daily reflections ("Your Content"). You retain full ownership of Your Content. Your journal entries are stored privately in your personal iCloud container via Apple CloudKit and are not accessible to us. We do not claim any rights to Your Content, and we do not read, analyze, or share it.
Content and Intellectual Property
The App contains guided reflection prompts, spiritual content, and related material. The App's design, code, icons, and original content are the property of Founder's Point and are protected by copyright and intellectual property laws. Traditional prayer texts and Ignatian reflection frameworks in the public domain remain in the public domain.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The spiritual content is provided for personal reflection and does not constitute professional counseling, theological, or pastoral advice.
Limitation of Liability
To the fullest extent permitted by applicable law, Founder's Point shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising out of or in connection with your use of the App. This includes, without limitation, any loss of journal entries due to iCloud sync issues, device failure, or other circumstances beyond our control. Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App, if any.
App Store Terms
Your use of the App is also subject to the terms and conditions of the platform from which you downloaded the App (e.g., Apple App Store). In the event of a conflict between these Terms and the applicable app store terms, the app store terms shall prevail to the extent of the conflict.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Founder's Point is organized, without regard to conflict of law principles.
